RELEASE OF LIABILITY AND ASSUMPTION OF RISK

In consideration of the services of DISCGOLFSCENE.COM (herein referred to as DISCGOLFSCENE), their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf, you hereby agree to release and discharge DISCGOLFSCENE, on behalf of yourself, your children, your parents, your heirs, assigns, personal representative and estate as follows:

1. You acknowledge that the activities involved in the participation in any of DISCGOLFSCENE services or promoted third party events, at any given location, entail significant risks, both known and unknown, which could result in physical or emotional injury, paralysis, death, or damage to yourself, to property, or to third parties. Such risks include, but are not limited to, damages for negligence, personal injury and/or loss, theft, identity theft, or destruction of personal property.
   
   
2. You expressly agree and promise to accept and assume all of the risks existing in these activities, both known and unknown, whether caused or alleged to be caused by the negligent acts or omissions of DISCGOLFSCENE. Your participation in this activity is purely voluntary, and you elect to participate in spite of the risks.
   
   
3. You hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless DISCGOLFSCENE from any and all claims, demands, or causes of action, which are in any way connected with your participation in this activity or events promoted by DISCGOLFSCENE, including any such claims which allege negligent acts or omissions of DISCGOLFSCENE.
   
   
4. Should DISCGOLFSCENE or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, you agree to indemnify and hold them harmless for all such fees and costs.
   
   
5. You certify that you have adequate insurance to cover any injury or damage you may cause or suffer while participating, or else you agree to bear the costs of such injury or damage yourself. You further certify that you have no medical or physical conditions that could interfere with your safety in this activity, or else you are willing to assume -- and bear the costs of -- all risks that may be created, directly or indirectly, by any such condition.
   
   
6. You agree to the validity and enforceability of this Release of Liability and Assumption of Risk without regard to any conflict of with applicable State law.
   
   
7. You agree to waive any claims of damages or refund against DISCGOLFSCENE for the failure of a third party event to fulfill their obligations, claims, and/or failure to meet the expectations of the event. Any and all refunds must be sought directly from the third party event and/or its organizers and will not be honored by DISCGOLFSCENE.
   
   
8. You agree to abide by the rules of the event and the terms and conditions of DISCGOLFSCENE.COM.

By using DISCGOLFSCENE's tournament registration services, you acknowledge that if anyone is hurt or property is damaged during your participation in a third party event, you may be found by a court of law to have waived your right to maintain a lawsuit against DISCGOLFSCENE.COM on the basis of any claim from which you have released them herein. You acknowledge that any refunds from canceled events must be sought directly from the third party event and/or its organizers and not DISCGOLFSCENE.COM.
